In compliance with data protection regulations, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data (“GDPR”) and Organic Law 3/2018, of 5 December, on the protection of personal data and the guarantee of digital rights (“LOPDGDD”), Ascend Business Progression Makers, S.L., (hereinafter referred to as “ASCEND”), provides you with the following information regarding the processing of your personal data.

2.When Does ASCEND Collects Your Personal Data?  

(i) ASCEND may collect users’ personal data in the following circumstances: Via the contact or “book a demo” form: ASCEND website provides a dedicated form where users can request a demo of the Ascend One technological platform (the “Platform”), inquire about its services, or submit complaints or claims. 

(ii)During the contracting process: When contracting our services, the Client will be required to provide contact details in order to create a user profile. This profile will allow the Client to access and configure the Platform. 

(iii) Creation of new users: Authorized users may create different profiles linked to the Client’s account, enabling them to enjoy the various functionalities offered by the Platform. For this purpose, ASCEND will only request identification and/or contact details of individuals for whom a user profile will be created under the Client’s account. 

(iv) Via email and postal correspondence: Users may reach ASCEND via the designated email address info@ascendmakers.com or postal address (Calle del Poeta Joan Maragall 1, planta 14, 28020 Madrid, Spain) to submit inquiries, complaints, claims, CVs, or other communications. 

(v) User’s account management: ASCEND may process data related to how users interact with the Platform. 

(vi) Through Cookies: ASCEND website uses cookies to collect information about user navigation. We recommend reviewing our Cookie Policy for more detailed information. 

Whenever there is a valid legal basis, ASCEND may process personal data to keep individuals informed about services, promotions, and products related to its activities through the communication channels provided (such as phone, email, SMS, and/or messaging systems), which it believes may be of interest. 

ASCEND may also process the data for statistical analysis purposes in order to assess the performance of its products and/or services, with the aim of improving the development and customization of its offerings. 


3.Purposes and Legal Basis for Processing Personal Data 


ASCEND processes personal data for the purposes and based on the legal grounds outlined below: 

(i) To assist, manage, and respond to inquiries, requests, comments, complaints, or claims submitted by users through any of the channels enabled for such purposes. 

Legal Basis: Consent granted by the user when submitting their inquiry or request (Article 6.1(a) GDPR). 

(ii) To register and create user accounts in the contracting process of the services provided by ASCEND.  

Legal Basis: Performance of a contract (Article 6.1(b) GDPR), when the user accepts the Platform's terms and conditions. 

(iii) For recruitment purposes, if the user submits their application to work with ASCEND. The data will be used to assess the application and manage a potential employment relationship. 

Legal Basis: Consent provided by the user when submitting their application. 

(iv) To comply with legal obligations and respond to judicial or administrative resolutions, including disclosing personal data to law enforcement authorities in cases where ASCEND or its authorized personnel suspect potential unlawful or criminal activity. 

Legal Basis: Compliance with ASCEND’s legal obligations (Article 6.1(c) GDPR). 

(v)To conduct statistical analysis in order to assess the performance of ASCEND’s products and/or services.  

Legal Basis: Legitimate interest (Article 6.1(f) GDPR), ensuring that our interest does not override your interests, rights, and fundamental freedoms. 

(vi) For services requiring a contractual relationship, personal data processing will be governed by the information provided during the contracting process.


4.Retention Period 

Personal data will be processed for the time strictly necessary to fulfill the purposes outlined in this Privacy Notice. Data will then be retained only to comply with applicable legal obligations. 

The retention period will be determined based: 

(i) The specific purpose for which the data was collected and whether that purpose has been fulfilled; 

(ii)Contractual or regulatory retention requirements. 


5.Recipients of Personal Data

Depending on the purposes for which personal data is collected, data may be shared with the following:  

(i) Financial institutions and payment platforms, if necessary to facilitate or verify payments.

(ii)Public authorities, regulatory bodies, and law enforcement agencies, in cases of legal obligation, judicial requirement, or sufficient evidence of unlawful or criminal conduct.  

(iii)Third-party service providers and partners. Where these entities act as data processors, ASCEND will ensure appropriate data processing agreements are in place in compliance with data protection laws.  

(iv)Authorized employees or collaborators of ASCEND, subject to applicable data protection obligations. 

ASCEND may transfer personal data outside the European Economic Area (EEA) through its partners and service providers. Such transfers are safeguarded through appropriate guarantees, including the use of Standard Contractual Clauses approved by the European Commission. 


6.User Rights

Users have the following rights regarding the processing of their personal data: 

(i) Access: The right to request confirmation of whether ASCEND is processing their personal data and access such data. 

(ii) Rectification: The right to request correction of inaccurate or incomplete personal data. 

(iii) Erasure: The right to request the deletion of personal data. 

(iv) Restriction of Processing: The right to request that ASCEND limits the processing of their personal data, retaining it only for the exercise or defense of legal claims.

(v) Objection: The right to object to the processing of personal data, except where legitimate grounds or legal claims prevail. 

(vi) Data Portability: The right to request the transfer of personal data to another data controller, where technically feasible. 

(vii)Automated Decision-Making: The right not to be subject to decisions based solely on automated processing.

Users may withdraw their consent at any time without affecting the lawfulness of prior processing based on consent.

Additionally, users may file a complaint with the Spanish Data Protection Agency (https://www.aepd.es) if they believe their rights have been violated. 

7.Modifications 

The processing of personal data will be conducted in accordance with the Privacy Policy in effect at the time the data is collected. Should ASCEND make changes to its data processing practices, users will be duly informed. 

8.Additional

Children’s Data: ASCEND’s services are intended exclusively for individuals of legal age. We do not knowingly collect information from minors. If you believe that a minor has provided us with their personal data, please contact us at privacy@ascendmakers.com.  

Third-Party Data: Users providing third-party data to ASCEND must ensure that the relevant individual has been informed of the contents of this Privacy Policy and has provided consent for the processing of their data. 

Sensitive Data: ASCEND does not collect or process sensitive personal data, such as information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, or data concerning health, sex life, or sexual orientation.
